Terms of Service

These Terms govern your use of the Tattoo Inkprep app and this website, provided by Guillermo Andújar Martínez (Spain, EU). By using Inkprep you agree to these Terms. If you do not agree, do not use the service.

1. The service

Inkprep is a professional support tool for color tattoo artists. You upload a clean digital design and Inkprep suggests tattoo inks that match its colors, optionally adjusted to a client's skin tone.

2. Not advice, no guarantee of result

Inkprep provides color reference suggestions only. It is not medical advice and does not guarantee any specific tattoo outcome. The final result on skin depends on the ink, the technique, the client's skin and the lighting. As a professional, you remain solely responsible for the inks you use and the work you perform.

3. Limitation of liability

To the maximum extent permitted by law, Guillermo Andújar Martínez is not liable for any outcome of a tattoo, for decisions made based on the app's suggestions, or for indirect or consequential damages arising from use of the service. The recommendations are a guide, and professional judgment always prevails.

4. Your designs and intellectual property

The designs you upload remain yours. You grant us only a limited license to process and store them as needed to provide the service to you (e.g. to analyze colors and save your projects). You confirm you have the right to use any design you upload.

5. Acceptable use

You agree not to misuse the service, attempt to disrupt it, or upload content you have no right to use. We may suspend or terminate accounts that breach these Terms.

6. Subscriptions and billing

Inkprep is offered as an auto-renewable subscription purchased through the app store. The subscription title, duration, price and any introductory offer or free trial are shown in the store at the moment of purchase.

Payment is charged to your store account (your Apple ID) at confirmation of purchase. The subscription renews automatically for the same period unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours prior to the end of the current period. You can manage or cancel your subscription at any time from your store account settings; the cancellation takes effect at the end of the current period. Where a free trial is offered, any unused portion is forfeited when you purchase a subscription. Refunds are handled by the app store provider under its applicable policies.

7. App Store terms

The following applies when you download or use Inkprep through the Apple App Store:

• These Terms are concluded between you and Guillermo Andújar Martínez only, and not with Apple. We, not Apple, are solely responsible for Inkprep and its content.
• Apple has no obligation to furnish any maintenance or support services for Inkprep.
• If Inkprep fails to conform to any applicable warranty, you may notify Apple and Apple will refund any purchase price paid for the app; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to Inkprep.
• We, not Apple, are responsible for addressing any claims relating to Inkprep, including product liability, any claim that the app fails to conform to a legal or regulatory requirement, and consumer protection claims.
• In the event of any third-party claim that Inkprep or your use of it infringes that party's intellectual property rights, we, not Apple, are responsible for the investigation, defense, settlement and discharge of such claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.

8. Governing law

These Terms are governed by the laws of Spain, without prejudice to the mandatory consumer-protection rights you may have under the law of your country of residence. Any dispute will be subject to the competent courts of Spain, again without prejudice to any mandatory consumer jurisdiction.

9. Changes & termination

We may update the service or these Terms; continued use means you accept the updated Terms. You may stop using the service and delete your account at any time.
